I - Acceptance of Terms of Use Agreement
This Terms of Use Agreement (“Terms of Use”) applies to the use of the Jaxson Industries LLC (“The Company”, “We”, “Us”) website which is located at www.jaxsonindustries.com and any or all related websites, (Collectively “Sites”) applications or services owned or operated by The Company (Collectively “Sites and Services”) as well as any offered services that may be offered in connection with the use of these Sites or Sites and Services or applications that are owned and operated by The Company whether it is accessed directly or indirectly, through a mobile supported device or telephony.
Your use of the Sites and/or Sites and Services constitutes that you agree to be bound and abide by the Terms of Use conditions without modification. You also agree that the Terms of Use may be modified, changed, or amended by The Company without notice to you and that you agree to check the Terms of Use each time you cause access or use the Sites and/or Sites and Services. You also agree that by logging in that it constitutes your complete acceptance of the current Terms of Use available on the Sites. You also agree that you will be subject to any applicable rules or guidelines modifications or changes that may be included or referred to in the Terms of Use document related to using any and all parts of the Sites and or Sites and Services made available to you.

BY USING AND/OR CAUSING ACCESS TO ANY OF THE SITES AND/OR SITES AND SERVICES OR FEATURES YOU AGREE AND ACCEPT WITHOUT MODIFICATION THAT YOU ARE FULLY BOUND BY THESE TERMS OF USE AND CONDITIONS, IF YOU DO NOT AGREE YOU MUST IMMEDIATELY CEASE ALL ACTIVITY AND USE AND MAY NOT ACCESS OR USE ANY OF THE SITES AND/OR SITES AND SERVICES FEATURES.
II - Sites and Services
Jaxson Industries LLC. agrees upon full adherence to the Terms of Use conditions by our authorized users to grant for personal use on an “AS-IS” basis access to the Sites and Services. You agree that Jaxson Industries LLC. exclusively reserves the right to modify, suspend, discontinue, change, update, delete or amend in whole or part, temporarily or permanently any of the Sites and Services with or without notice at any time and for any reason at the sole discretion of The Company.
You agree that you will not exploit in any form the Sites and Services, or any information contained within by transmittal, duplication, reproduction, modification, distribution or otherwise without the express written consent of Jaxson Industries LLC. except as for your personal use as described in the Terms of Use. The Company shall have no liability or responsibility to any user or third party for any changes to the Sites and Services in whole or part and shall have no liability or responsibility for data or information provided.
III - Trademark and Copyright Notice
The Company does not grant express, implied or otherwise the use of any service mark, trademark or logo (Collectively “Trademarks”) used or on display within the Sites whether registered or unregistered without prior written consent by the respective Trademarks owner/s.
Similarly any and all media including but not limited to designs, arrangements, text, music, videos, artwork, graphics, software, logo images or otherwise (Collectively “Content”) may not be exploited in any way that would violate the property rights or laws real or intellectual of the Content owners including but not limited to being sold, published, displayed, altered, transmitted or compiled for any purpose without the prior express written consent of The Company.
The company disclaims any and all liability and/or responsibility that may arise from the use of any Content contained in connection with the Sites by its users. The Company does not grant any rights to any of the Trademarks or Content on the Sites except as expressly stated in the Terms of Use and you agree that The Company has no obligation or expectation to review any of the user provided Content for such violations. If you suspect possible copyright infringement or a violation may have occurred, please contact us immediately using the contact information provided on the Sites.
IV - Accessibility
You expressly acknowledge and agree that the Sites and Sites and Services provided may experience or be subject to failures, delays, downtime, inaccessibility and general limitations inherently related to electronic communications and the use of the Internet and that The Company is not liable or responsible to you in any way.
V – Refunds & Returns
Refunds for training courses purchased will be approved upon notice of intent provided by the purchaser to Jaxson Industries LLC no later than 30 calendar days before the schedule day of the training course by contacting customer service via email at connect@jaxsonindustries.com. If notice is given by the purchaser less than 30 days from the scheduled day of the course, they will have the opportunity to reschedule for courses at a future date.
VI - Warranty Disclaimer & Limitation of Liability
YOU UNDERSTAND AND AGREE THAT THE CONTENTS OF THE SITES AND SITES AND SERVICES ARE PROVIDED ON AN “AS IS” BASIS TO YOU AND WITHOUT ANY WARRANTIES OF ANY KIND EXPRESS OR IMPLIED. IT IS PROVIDED TO YOU FOR YOUR USE AT YOUR OWN RISK AND YOU AGREE THAT THIS DISCLAIMER INCLUDES BUT IS NOT LIMITED TO THE SERVICE BEING UNINTERRUPTED, TIMELY, ACCURATE, RELIABLE, FIT FOR PARTICULAR PURPOSES, NON-INFRINGEMENT, ACCURACY, SECURE, SAFE VIRUS FREE CONTENT OR DOWNLOADS, ERRORS, OMMISSIONS, GENERAL COMPLETENESS, MERCHANTABILITY OR SUITABILITY.
THE COMPANY ASSUMES NO LIABILTY FOR ANY PUNITIVE DAMAGES OF ANY KIND WHETHER DIRECT, INDIRECT, INCEDENTAL, CONSEQUENTIAL OR RESULTING FROM THE USE OF THE SITES AND SITES AND SERVICES, AFFILIATE OR THIRD PART SERVICES OR ANY POLICIES. YOU AGREE TO ASSUME ANY AND ALL COSTS ARRISING FROM THE USE OF THE COMPANY SITES AND SITES AND SERVICES INCLUDING BUT NOT LIMITED TO CORRECTIONS, SERVICING OF EQUIPMENT AND ALL ASSOCIATED REPAIRS.
The preceding disclaimer and limitation of liability may not apply to you as some jurisdictions may not allow disclaimers of implied warranties or limitation of liability.
VII - Communications
You acknowledge and agree that any and all communications with The Company may or may not be monitored, kept or recorded at the sole discretion of The Company including but not limited to, hardcopy correspondence, electronic communications email, text or telephone calls.
VIII – Third-Party Links
You acknowledge and agree that available links to Third Party Sites are not controlled by The Company and that The Company is not responsible for any functionality or Content made available to you through the use of such links. You expressly agree that the use of such links is governed by the Third-Party Sites policies including but not limited to their terms and conditions, privacy policy etc. and that availability does not constitute endorsement by The Company.
IX - Indemnification
You agree to indemnify, defend and hold harmless Jaxson Industries LLC., its officers, managers, owners, employees, agents, designees, users, successors, service providers and suppliers from and against all losses, liabilities, expenses, damages, claims, demands and costs, including all reasonable attorneys’ fees and court costs due to or arising from:
- Any violation of these Terms of Use by you
- Any inaccurate or untruthful Content or other information provided by, submitted, transmitted or otherwise made available by you to Jaxson Industries LLC. through the use of the Sites and Services
- Any intentional or willful violation of any rights of another or any harm you may have caused to another.
Jaxson Industries LLC. will have sole control of the defense of any such damage or claim
